The answer is NO. Under California law the results of a polygraph test are not admissible unless both the prosecution and defense agree that the results are admissible.   1. Usually, your attorney would ask you to submit to one privately first to see how you do. If you pass, your attorney may consider bringing the results to the DA. Sometimes the DA may agree to dismiss a case if they get such a report stating that you were truthful on the test. It is inadmissible in court because the scientific community does not deem the results reliable. Many DA’s still like the test and will consider it- especially for negotiations of the case. I would never recommend a client take such a test when asked by the police prior to any filing of a criminal case. Ever!!!
