Bike Theft in California

In determining the value of the property obtained, the reasonable and fair market value shall be the test.

In Newport Beach, three individuals were arrested over this last weekend for attempting to steal bicycles.  The police have noticed an increase in the amount of reports of bicycles being stolen. One alleged victim, caught and detained after Jonathan Robert McBeth, tried to ride away with his bicycle.

The next day in a separate incident, the owner of the another bicycle saw two brazen young adults trying to cut the lock off of his bicycle near Seashore drive. Eventually police responded to the area and found both individuals, who were holding on to bolt cutters.

What Must be Proven in Order to be Convicted of Theft

To prove that you or a loved one is guilty of this crime, the prosecution must prove:

  1. You took possession of property owned by someone else;

    bike theft is a serious crime in CA.
    The authorities do not take bike theft lightly.
  2. You took the property without the owner’s consent;
  3. When you took the property you intended to deprive the owner of it permanently or to remove it from the owner’s possession for so extended a period of time that the owner would be deprived of a major portion of the value or enjoyment of the property; And
  4. You moved the property, even a small distance, and kept it for any period of time, however brief.
