Although McGowan was already sentenced to 45 years to life in state prison, this case focused on his wife’s alleged failure to protect the child. Montgomery noted that the McGowans appeared to be ordinary neighborhood grandparents.

Montgomery explained that they claimed Terriann Kuhlmann, the abuser’s wife, was negligent because she failed to protect the children. She ignored warning signs and her husband’s predatory actions toward three previous victims over a decade. He mentioned that such negligence is a recognized type of legal claim and is generally covered by homeowner’s insurance. The $46 million award comprised $20 million for past non-economic damages, $25 million for future non-economic damages, $262,000 for future medical costs, and $780,000 for future lost earning potential. The jury found Dana McGowan 60% responsible and his wife 40% responsible for the harm done to M.S.
