What is Non-Revocable Parole and Can I Qualify for This Type of Parole?

Non-Revocable Parole is a non-supervised version of parole where parolees do not have to report to a parole agent. This law went into effect on January 25, 2010, and the Department of Corrections and Rehabilitation started screening inmates paroling between April 1, 2010 and July 31, 2010 for placement onto Non-Revocable Parole. The screening for placing parolees onto Non-Revocable Parole started on January 25, 2010 and took approximately four months to complete.Not everyone is eligible to be on Non-Revocable Parole. This special program is limited to individuals who meet the following criteria:

  • The person is not required to register as a sex offender;
  • The person was not sentenced to prison for a serious or violent felony (lewd or lascivious act upon a child under 14 years of age is a serious felony in California)
  • The person was not convicted as a sexually violent predator and does not have a prior conviction as a sexually violent offence;
  • The person is not a validated prison gang member or associate;
  • The person did not refuse to sign any written notification of parole requirements or conditions;
  • The person was evaluated by the department and was not determined to pose a high risk to reoffend, and
  • The person was not found guilty of a designated serious disciplinary offense during his or her current term of imprisonment.

Keep in mind that being on Non-Revocable Parole does not relieve individuals of any registration requirements, and they must still comply with all provisions regulating their release including subject to being searched by any law enforcement officer at any time. Unless the Board of Parole Hearings indicates that individuals have a requirement to complete a Batterer’s Program, parolees will be discharged within 30 days of having been on parole for one year.
