What happens when the feds raid my house?

If your house was searched by the police and your computer was taken away, you may be in trouble. Many times, the police or federal authorities are looking for child pornography so they take your computer to search. The search can last days, weeks and sometimes months before they let you know what they intend to do. Questions commonly asked:

Can I get my computer back?
Answer: yes- but usually you need to wait and see if formal charges have been filed.

What happens if the cops come to the door?
Answer: if they have a warrant to search, you must comply. If they do not, do not consent to the search.  In either situation, never ever make a statement to the police. 6 words of advice here “Shut up, shut up, shut up”.

What can they charge me with if they find child pornograpghy on my computer?
Answer: They can charge you with either a state or federal violation of the law. If you shared your files with others, they could also charge you with distribution and not just possession.

What if I didn’t know it was child pornograpghy?
Answer: The prosecutor must prove that you possessed it and knew it was child pornography. If you did not know, or if someone else used your computer, you may be not guilty of the  crime.

Word to the wise…. remain silent and hire a criminal defense attorney as soon as you can. Your attorney can call the agency that did the search and see  what is going on. They can also speak to the prosecutor assigned to the case  (state or federal) and try to influence them on what they intend to charge and to avoid future arrest.
