The Power Social Workers Have: CACI Information (WIC 300))

Wallin & Klarich’s Child Abuse Index defense lawyers in Orange County have 40 years of experience helping clients whose children get taken away by Child Protective Services because of false accusations of sexual child abuse. The power we have given to social workers and the police to take our children with minimal to any evidence is quite alarming.

Imagine that you are at home watching TV with your 3 young kids and your wife. Suddenly, the police and social workers come barging into your house. Without your permission, the police take you to the kitchen as the social workers grab your 3 kids (ages 4, 6 and 9) and take them into different bedrooms. Without your knowledge or consent, the social workers begin to ask your children the following questions:

  1. Has your daddy put his mouth on your private parts?
  2. Has your daddy had you touch his private parts?
  3. Has your daddy placed his private part in your private part?

Your children are frightened and are crying! Of course your kids deny that any of this has happened through their tears. They want to be with their mommy and daddy, but their mommy is not allowed to go to them.

The police then question you at the kitchen table, and they tell you that they know you have molested the four year old girl who was playing with your daughter and your two other children. You are blown away because you were never alone with this girl. You were at work for the entire day except for 20 minutes right before her parents picked her up. You have no idea why you are being accused of molesting this child. All you know is that you are now an “accused child molester.”

The social worker tells you and your wife that she is taking your three children into “protective custody,” and they will be in a home for abused children.

Everyone is crying, except the cops and social workers – who think you are a child molester – as they push your children out the front door while the kids are doing all they can to run away from them.

What Can Social Workers Legally Do?

Well, it turns out that the 3 children are kept away from their parents for 3 days with no contact. Then, they are only allowed to see their parents with a social worker in a ten by ten office, 2 hours a week, for the next six weeks. Finally, after six weeks, they are allowed to come home.

The most shocking of all is that – during this six-week-period – the social workers who took your children from you NEVER BOTHERED TO EVEN INTERVIEW THE ALLEGED FOUR YEAR OLD VICTIM. They merely read a police report taken by a police officer who might have had a few months experience on the job and maybe with no experience talking to children!!!!

Well it turns out that the police and the social workers made a “mistake.” No molest occurred, and your children are returned to you after six weeks.

Your children will be traumatized for many years to come and possibly forever. They will have nightmares of strangers coming and taking them out of their home again…and what do you get from the police and social workers? Do you get an “apology?” Do you get any compensation for their “mistake?” The answer is you get NOTHING. No apology. Not one dime to pay for the therapy bills you will have to pay for your children to try to recover from this nightmare.

Again, the power we have given to social workers and police to take our children with minimal to any evidence is alarming.
