Wallin & Klarich Win Not Guilty Verdict In Serious Domestic Violence Case

We recently had a client that was charged with Domestic Violence. His situation was particularly bad because he had just recently been convicted of a previous Domestic Violence Charge only 2 years earlier. That meant that he was on Probation and facing up to 2 years of jail time. Our client was sure that he was innocent and that his girlfriend had set him up. We were able to subpoena the 911 audiotapes and we also subpoenaed the negatives of the pictures they had taken of his girlfriend. We had to take this case to trial to prove he was innocent because the district attorney wanted him to do time in jail. During the trial, we were able to play the 911 tape to the jury and the jury was able to see how the girlfriend didn’t sound scared at all. In fact, she sounded like the aggressor! During the trial, we were also able to show the jury that the Police had taken 8 different pictures of the girlfriend and since no injuries were visible on the pictures, they did not turn them over to us. The district attorney attempted to prove his case by showing how horrible my client’s prior conviction of 2 years ago was. The jury didn’t fall for it. We were able to show the jury that my client was in fact innocent of the charges and all 12 jurors agreed and voted unanimously not guilty. We were very proud to help him get past this nightmare.
