A Wallin & Klarich client who was facing 25 years to life in prison for allegations of first-degree murder in Victorville has been released from custody after charges were dismissed by the District Attorney.
Wallin & Klarich Criminal Defense Attorney Jonathan Lynn was able to show that DNA evidence law enforcement believed linked our client to the 20-year-old cold case was unreliable and get the case against our client dismissed.
The San Bernardino County Sheriff’s Department arrested our client in an investigation involving the 1997 murder of a Hesperia woman. DNA samples on the victim’s body matched our client, according to law enforcement officials.
However, Attorney Lynn worked with a forensic science expert when reviewing the DNA evidence. Mr. Lynn established that our client was dating the victim at the time of the alleged incident, and the DNA expert showed that the DNA that matched our client was consistent with someone who was in a relationship with the victim and thus did not implicate our client. Additionally, the forensic expert found untested hair samples on the victim, which did not match our client when tested.
“Our client consistently denied committing this crime,” Mr. Lynn said. “With the help of our DNA expert and additional lab results, we were able to show the District Attorney that the DNA evidence was inconsistent with our client committing the murder and convince prosecutors to dismiss all charges.”
Law enforcement officials plan to re-test all DNA samples found on the victim in order to identify a suspect in the case.
