YES, your driving privilege can be suspended if you are arrested for a DUI. When you are arrested if the police officer believes you are driving with .08 or above in your system then they will take your drivers license and provide you with a “pink paper”. This pink paper tells you that you have ten days to contact the DMV to request a DMV hearing. If you fail to contact a lawyer to request a DMV hearing for you, then you must do so yourself within this ten day period. The problem is that often the DMV will tell you that you do not need a hearing and if you listen to them you will end up losing your driving privilege.

If you do not demand a DMV hearing within ten calendar days then the pink paper acts as a valid drivers license for 30 days from the date of your arrest. However, 31 days after your arrest your drivers license will be suspended for a period of four or six months, and you will have to enroll and complete an alcohol education class before you can obtain your license back.

If you are wise enough to retain a lawyer to help you then the law firm will demand a hearing with the DMV for you. If this happens then your license will not be suspended and will remain valid pending the outcome of the DMV hearing. If you prevail at the DMV hearing then your license will not be suspended by the DMV. Then the battle shifts to the court where your lawyer will do all he can to have the DUI reduced to a lesser charge so that you do not lose your driving privilege.
