Corporal injury on a spouse can be charged as either a misdemeanor or a felony depending on the facts of your case. As a misdemeanor, corporal injury on a spouse is punishable by up to one year in county jail and/or a $6,000 fine.

As a felony, it is punishable by up to four years in jail and/or a fine up to $6,000. If you have a previous conviction for battery, sexual battery, or another type of aggravated assault, you may be sentenced to five years in state prison. If the victim was seriously injured, this sentence can be extended.
