If the police conducted a search of your home and seized your computer, you need to hire an experienced criminal defense attorney immediately. More then likely, your computer was seized due to suspected illegal activity. This activity could include wire or mail fraud or perhaps possession of child pornography. The computer will be analyzed by the police agency to determine if your computer contains anything illegal. This search could take days or even months. Your attorney should be contacting the agency to assess the status of the investigation and inquire if you will be arrested. Many times, your attorney can arrange a release on your own recognizance (an OR) rather than have you arrested. In addition, they would contact the District Attorney or the US Attorney (if the case is being prosecuted federally) to discuss your case and try to influence how they charge.

  1. Although the police may seize your computer, it is critical that you do not make any statements about the investigation, or perhaps what you might have done to the police. You have a 5th Amendment right to remain silent. REMAIN SILENT!I recently had a client who made incriminating statements during the search. Had he not made a statement, his case would have been defensible. REMAIN SILENT!!!!!!
