The California Rules of Court (CRC) set the deadlines for appealing criminal convictions in California. Under rule 8.853(b), in a misdemeanor case, you must file your notice of appeal within 30 days after the trial court makes its final judgment in your case. This is usually the date that you are sentenced. The deadline for filing your notice of appeal cannot be extended and if you file it late, your appeal will not be heard. Appealing criminal convictions is a very specialized area in criminal law and anybody thinking of appealing should consult with a criminal appeals lawyer immediately due to the strict time constraints and intricate legal issues involved.
