Possession of child pornography is a serious crime in California and can lead to jail time and registration as a sex offender. In many cases involving possession of child pornography the illegal material is found on the defendant’s computer. There are forensic computer experts who can go into your computer and likely be able to determine when the material was downloaded onto the computer and whether the material was viewed, how many times, and when. There have been many cases where illegal child pornography was inadvertently downloaded at the same time people were attempting to download only legal adult pornography. In a prosecution for possession of child pornography the prosecutor has to prove that the defendant knew the illegal material was in their possession.
