Certain sex crime convictions could lead to earlier eligibility for a certificate of rehabilitation. Under California Penal Code section 4852.01, the time of rehabilitation is usually 10 years from the date a defendant was placed on probation or released on parole. However, pursuant a recent California Court of Appeal case in People v. Schoop (2012 DJDAR 17373, the court found certain sex crime convictions (311.1) could allow a certificate of rehabilitation to be filed after a 7 year rehabilitation time and not 10 years as previously cited in the code. The court found no rational basis to wait the full 10 years when other sex crimes require a 7 year waiting period before filing a certificate.
