Public Intoxication

Public intoxication, is a crime that is abused by both prosecutors and law enforcement officers in that they make arrests and bring charges in many cases where they would be unable to prove guilt at trial. To be found guilty of the crime public intoxication, it is not enough to simply be standing around out in public after having a few beers. It is also not enough to be arguing with cops after having a few beers.

There are two ways in which a person can be found guilty of public intoxication. First, a person is guilty of public intoxication if he is so intoxicated that he is unable to care for himself or others. For example, if you are so drunk you are unable to use your cell phone to call a taxi and unable to walk home, then you may be drunk enough for the purposes of public intoxication.

The second form of public intoxication is when a person is so intoxicated that he interferes with a street or sidewalk. For example, if you are so drunk you are passed out in the middle of the sidewalk or you are so drunk that you become belligerent and refuse to leave a public place upon the demand of law enforcement, then you may be drunk enough for the purposes of public intoxication.
