Lawyer Gets Charges of Possessing a Weapon Dismissed
Recently, an Orange County weapons lawyer from Wallin & Klarich got all charges dropped after his client was accused of possessing a weapon on school grounds in violation of PC 626.10. If convicted, the client would have faced up to one year in Orange County Juvenile Hall.
“I have represented hundreds of young men and women like this client for almost a quarter century,” claimed the attorney. “Juvenile law is a very specialized area of practice that few attorneys understand or do much work in. That’s certainly not the case with me, and my Juvenile clients get the benefit of my expertise and hard work.”
The client, a special needs student, had no prior history of violence or other inappropriate behavior at school. Recognizing this, the attorney immediately persuaded his client to attend counseling. He also compiled letters of reference from his client’s family members and friends. These tactics proved to be highly effective as the charges were dropped after the young man completed 80 hours of community service. He was facing up to one year in Orange County Juvenile Hall.
California Penal Code 626.10 forbids a number of weapons near school grounds. You may not possess any dirk, dagger, folding knife, or blade longer than 2.5 inches on school grounds. This statute also prohibits any instrument that expels a metallic projectile such as a BB or a pellet. PC 626.10 applies to any private or public school providing instruction kindergarten or any grades 1 to 12. If you are convicted under PC 626.10, you may be sentenced to county jail for up to one year.
