No! If you have been cited for speeding under California Vehicle Code Section 22350 (CVC § 22350), do not just give up and pay the ticket! If you just pay the ticket a point will be placed on your record and your insurance rates will increase. You have options:

1. First of all, Traffic School is an option if you have not attended Traffic School in the last 18 months. Completing Traffic School will save your driving record and the ticket will not be reported to your insurance.

2. However, before agreeing to do Traffic School, you should appear in court and set the case for a Traffic Trial. The court will require you to post a bail (the total fine amount), but this will be returned to you if you win. Also, if you hire an experienced traffic attorney, this attorney can have the bail waived (referred to as an OR release).

3. If you set it for trial and the officer does not appear, YOU WIN! There is actually a good chance that the officer may not appear. Every day, tons of traffic tickets are dismissed due to the citing officer’s non-appearance at the traffic trial.

4. If the officer does appear, you can still request traffic school before your traffic trial begins.
