Do I have an advantage in my divorce if my spouse cheats?

Can I use the fact that my husband or wife cheated to get the upper-hand in my divorce? From time to time, we get asked this question. The answer to this question is simple: no. The reason is because California (and now all other states) is a no-fault state when dealing with divorces.

Neither spouse needs to show any wrong doing by the other spouse. In other words, it does not matter who’s fault it was for the break-up of the marriage. Thus, the mere fact that a spouse cheated will not give the other spouse the upper-hand in their divorce.
