California Changes Compassionate Release Law (Government Code 26605.6, 26605.7, 26605.8)

California recently modified the compassionate release law that will allow you to be released from county jail if a medical doctor examines you and finds that you have less than six months to live. In addition, it must be determined that you are not a threat to public safety in order for you to be released.

CrimeThe law also allows you to be released from jail on medical probation, if you have a medical condition that prevents you from performing basic daily activities and you require 24-hour care or long-term inpatient rehabilitation services. However, if you are released on medical probation and are later found to no longer qualify for medical release, you can be returned to custody. Medical probation, or medical parole, allows you to be released from custody in order to be cared for at home by loved ones or in a designated long-term health care facility. Medical probation is also available to you if you are serving a sentence in the state prison system. If you are a state prisoner, in order to be released you must suffer from permanently incapacitating medical condition and must not pose a severe risk to public safety.
