Bill Approved to Allow Electronic Monitoring of Domestic Violence Defendants

A bill crafted after the 2009 slaying of a California woman cleared its first hurdle this week.  Known as “Lisa’s Law,” the legislation is named for Litizia “Lisa” Zindell, who was 30 at the time she was killed. Zindell was killed by her ex-fiance the day after his release from jail, despite several restraining order violations.

The California Assembly Appropriations Committee approved the bill Monday.  Members of the committee stated that the bill will give victims of domestic violence more protection and safety from their alleged abusers.  The bill allows for the electronic monitoring of defendants in domestic violence cases.

In California, domestic violence is codified in part under Penal Code section 273.5.  It states in pertinent part that “any person who willfully inflicts upon a person who is his or her spouse, former spouse, cohabitant, former cohabitant, or the mother or father of his or her child, corporal injury resulting in a traumatic condition is guilty of a felony.”  If convicted, a defendant faces up to four years in custody
