Are You Being Investigated by the Police for Hit and Run?

Have you been involved in a hit and run, but I don’t know what to do or recall what happened? Maybe police have come to you or left their card for you to call them but you do not recall getting into a collision or maybe another person was driving your vehicle when something happened to them and now you are getting blamed. Maybe no one was around and there was nobody to notify.

Whether or not you have been questioned by the police, your best bet is to hire an experienced criminal defense attorney.  You should NOT under any circumstances call law enforcement, yourself. A better plan would be to have your criminal defense attorney firm contact them on your behalf to find out more information.

If during the course of the investigation, there is an allegation that another person was injured, then you could be facing felony hit and run charges. If nobody was injured, you potentially would be facing misdemeanor hit and run charges.

To prove that you a re guilty of hit and run, the prosecution needs to prove that you:
1. While driving, were involved in a vehicle accident; 2. The accident caused damage to someone else’s property; 3. You knew that you had been involved in an accident that caused property damage; AND 4. You willfully failed to perform one or more of the following duties:     (a) To immediately stop at the scene of the accident;         OR     (b) To immediately provide the owner or person in control of the damaged property with your name and current residence address.

If you or a loved one are being investigated for or are charged with hit and run, it is very important that you speak with an experienced criminal defense attorney immediately, like the attorneys at Wallin & Klarich.
