Weapons Charge Reduced To No Jail Time After Wallin & Klarich Retained
Our client was charged with brandishing a firearm in public. The charge carried a mandatory 90 days in county jail. The client insisted that he had pointed his finger, and the alleged victim was more than 50 feet away when he says he saw a gun. The client did have a gun similar to the one described by the victim. This looked like a good case for trial, but the client was interested in a plea if he could avoid jail time. When the judge heard that we were going to trial, he discussed the case with us and agreed that the client should not have to do jail time. Result: Our client spent no time in custody.
