Lindsay Lohan Will Soon Face Felony Grand Theft Charges – Penal Code 487(a)

According to TMZ.com and other internet sources, the Los Angeles District Attorney’s Office plans to charge Lindsay Lohan with felony grand theft for allegedly walking out of a jewelry store wearing a necklace but without having paid for it.
Sources report that Lohan had been been to the store multiple times, and had been eyeing a $3,400 necklace.  Security cameras reportedly show Lohan walking out of the store with the necklace.

Lohan released a statement indicating that the jewelry store had agreed to loan her the necklace.  After the jewelry store reported the alleged theft to the police, Lohan had a stylist return the necklace to the store.  The store stated that loans require a significant amount of paperwork, but there is no indication that Lohan ever filled out the required documents.  The security camera did not indicate whether a store employee verbally agreed to loan the necklace to Lohan because it did not record sound.
Under Penal Code section 487(a), grand theft is the unlawful taking of property valued over $950.  Grand theft is punishable by up to a year in jail or up to three years in state prison.
