Wallin & Klarich Wins Appeal For Client Accused of Sex Crimes
The Fourth District Court of Appeals agreed with the attorneys at Wallin & Klarich and struck down and modified many conditions of probation on a sex crime defendant. The Appeals Court sided with Attorney Stephen Klarich and ordered the Superior Court of Orange to change their sex crime probation terms to comply with Constitutional standards.
The Judge imposed terms of probation that Mr. Moses felt were unfair and illegal. After he was sentenced, he hired Wallin & Klarich to attack the terms of probation. We did and the Court of Appeal agreed. Many of his conditions of probation were deleted or modified.
In People v. Moses* G044482, (*certified for partial publication) the Court of Appeals ruled that many standard conditions of probation that Orange Count courts impose are unconstitutional and need to be changed. The Court of Appeal ordered the Superior Court Judge to modify many conditions of Mr. Moses probation and further requested Orange County Superior Court to update and change there “Sex Offender Terms and Conditions of Probation” form.
