BIG Break For Those Facing Serious Jail Time In California
Governor of California signs new law allowing judges to dramatically lower potential sentences for those facing serious crimes
A new law signed into law by Governor Newsom (Senate Bill 81) mandates judges to dismiss certain sentence enhancements if the court finds that it is in the interest of justice to do so.
District Attorneys regularly file “enhancements which are capable of adding in some cases decades of additional mandatory punishment for those convicted of certain crimes.
This new power for judges takes effect for all sentencing hearing that takes place after January 1, 2022. This means in many cases it may be in the best interest of lawyers representing those facing serious criminal cases to move to continue those cases beyond January 1, 2022.
There are several reasons outlined in the new law that would permit a judge to dismiss an “enhancement”. One of these reasons is if the enhancement would result in a defendant being sentenced to over 20 years in prison. Another reason for a judge to have the power to dismiss an enhancement would be if the crime was connected to mental illness or childhood trauma suffered by the defendant.
