An attorney caught embezzling? Penal Code 503
Last month, attorney, Peter Nitschke was charged with embezzling more than $720,000 from his client trust fund from two sisters whom he apparently he had befriended. Nitschke allegedly offered to help two sisters after their 95-year-old mother died and left them more than $675,000, according to the Orange County district attorney’s office. The sisters are 65 and 69 years old.
Nitschke was president of their church congregation in Laguna Woods. Nitschke is accused of then spending the money or hiding it by moving it into other accounts.
Under Penal Code section 514, every person guilty of embezzlement is punishable in the manner prescribed for theft of property of the value or kind embezzled; which could be a misdemeanor or felony, and is punishable by a sentence of jail up to one year or imprisonment in the state prison, depending on the amount of loss.
