Two Teens Escaped!
It was reported that two teenagers took off from the Joplin Youth Center on Tuesday night and are still on the loose. This is a minimum security facility. An on going search is being conducted for the two individuals. The two escapees were serving minimal sentences for probation violations. Apparently, the boys were outside exercising when they decided to jump the fence and leave the facility.
What Must be Proven For You to be Convicted of Violating PC 4532
If you have been charged with escape or attempting to escape in violation of Penal Code section 4532, the People must prove that:
1. You were a prisoner who had been arrested and booked for, charged with, or convicted of a misdemeanor or felony and committed by order of the juvenile court to an adult facility;
2. You were confined in a county jail facility or equivalent facility; AND 3. You escaped or attempted to escape from the jail facility or equivalent facility.
Escape means the unlawful departure of a prisoner from the physical limits of his or her custody. However, the prisoner must pass beyond some barrier, such as a fence or a wall, intended to keep the prisoner within a designated area.
Every prisoner arrested and booked for, charged with, or convicted of a misdemeanor, who is confined in any county or city jail, prison, industrial farm, or industrial road camp, and who thereafter escapes or attempts to escape from the county or city jail, prison, industrial farm, or industrial road camp or from the custody of the officer, is guilty of a felony and, if the escape or attempt to escape was not by force or violence, is punishable by imprisonment in the state prison for a determinate term of one year and one day, or in a county jail not exceeding one year.
