Abductors Sentenced To 431 Years For Kidnapping And Sexual Assault Charges
Phillip Garrido and his wife Nancy Garrido were sentenced in a California court for their crimes in the well known kidnapping and sexual assault of Jaycee Dugard. Dugard was abducted as a child in front of her family’s Lake Tahoe home. She was held captive by the Garrido’s for 18 years.
Phillip Garrido was sentenced to 431 years to life in prison. Nancy Garrido was sentenced to 40 years to life for her role in the crimes. Phillip Garrido previously plead guilty to 1 count of kidnapping, and 13 counts of sexual assault.
In California, rape is codified under Penal Code Section 261. It states in pertinent part that rape occurs when there is sexual intercourse “Where it is accomplished against a person’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another”.
If convicted of rape, a person faces up to eight years in state prison on a 1st offense.
