ASSAULT WITH A DEADLY WEAPON- VEHICLE
I had no prior criminal record and had always been a law-abiding citizen until I was arrested for something that happened a year earlier on the freeway….something I didn’t do. I was arrested for 2 felony counts of Assault with a Deadly Weapon (vehicle). I was facing years in state prison and a lifetime revocation of my driver’s license.
About a year ago, I was driving in heavy traffic following my fiancé home when a lady illegally veered into my fiancé’s lane ahead of me forcing my fiancé drive her vehicle into the center median almost colliding with the retaining wall. The lady did not even notice and just drove off. I immediately called my fiancé’s cell but got no answer. At the time, I had no idea if my fiancé’ had collided with the retaining wall or had been hurt or injured, so I followed the lady off the freeway. As I got closer to her vehicle, I tried to get her attention to stop and exchange insurance information, however, she wouldn’t look at me so I continued to follow her while yelling out the window. I followed her off the freeway and onto side streets when my fiancé called me back to advise me that she did not hit the wall and was not hurt. That is when I turned my vehicle around and headed back toward the freeway without getting the lady’s insurance information. About a year later, police come to my residence to arrest me for AWDW charges based upon the lady’s claims that I had tried to hit her with my vehicle and threatened to hurt her…which was not true.
