Singer Christina Aguilera Arrested For Public Intoxication and Boyfriend Matthew Rutler Arrested For DUI- P.C. 647(f); Vehicle Code 23152 (a); P.C. 851.8

Singer and song writer Christina Aguilera and her boyfriend Matthew Rutler were arrested on March 1, 2011 at 2:45 a.m. for public intoxication and suspicion of driving under the influence.

According to media sources, Los Angeles County sheriff’s stopped the vehicle just off the Sunset strip and arrested Matthew Rutler, 25, for suspicion of driving under the influence. Sheriff Deputy Bill McSweeney said Aguilera was arrested because she appeared too drunk to care for herself and had no driver to take her home.

Sheriff spokesman Steve Whitmore explained that Aguilera won’t be charged with a crime, although the misdemeanor arrest will remain on her record. However, under California Penal Code 851.8, Aguilera may petition the law enforcement agency to seal and destroy her arrest record.

In any case where a person has been arrested and no accusatory pleading is filed, the person arrested can file a petition with the law enforcement agency under penal code section 851.8 to destroy its record of the arrest. A copy of the petition will then be served to the prosecuting attorney of that county and with concurrence of the law enforcement agency will have the ability to seal its arrest records.

Aguilera was released from the back of the police station at about 7:30 a.m., avoiding the paparazzi, while Rutler was jailed on $5,000.00 bail.
