Many people who feel they’ve been unfairly convicted after a jury trial want to pursue an appeal to get the conviction overturned. The first thing you need to know is that a notice of appeal must be filed with the court within 30 days of your misdemeanor conviction. More importantly, an appeals court will only consider evidence that is part of “the record” in your case, including what was testified to at trial and mistakes that may have been made by the Judge, prosecutor, or your lawyer. New evidence will not be considered as part of an appeal. It is very important to consult with an experienced appeals attorney who would need to evaluate your case to give you a better idea of the prospects of winning your appeal.
