			<content:encoded><![CDATA[<p>Sitting down on a hot Southern California day with a cup of Pinkberry frozen yogurt is about as relaxing a day as one can get.  Perhaps Pinkberry co-founder, Young Lee, could use a few more trips into one of his establishments to let off some steam.  The 47 year old was arrested at LAX airport this morning on assault charges.  Thankfully for Lee, Pinkberry is wildly successful, so he should be able to afford a top notch <a href="http://www.wklaw.com/wklaw-los-angeles-century-park.html">Los Angeles assault attorney</a>.</p>
<p>Lee was arrested on a warrant after an alleged incident with a homeless man back in June of 2011.  The incident took place on a freeway off-ramp.  The homeless man was apparently panhandling, and following a verbal exchange, Lee and his passenger allegedly got out of the car, chased down the homeless man and beat him with a tire iron.</p>
<p>Details of the exchange and the alleged assault aren’t available, but if convicted, Lee faces some very serious consequences.  The <a href="http://www.wklaw.com/wklaw-los-angeles-century-park.html">punishment for aggravated assault</a> could be as many as four years in state prison and a strike on Lee’s record should he be found guilty. Rodgers allegedly got into an argument with a female at the location. <p>The man was arrested and booked in Ventura County Jail.  Rodgers was taken to the hospital with non-life-threatening injuries to her head and wrist.  Ventura police arrested the man for <a href="http://www.wklaw.com/areas-assault.html">assault with a deadly weapon</a>.</p>

			<content:encoded><![CDATA[<p>A Gardena High School student suspected of bringing a gun to campus that discharged and wounded two students has been charged with <a href="http://www.wklaw.com/areas-assault.html">assault with a deadly weapon</a>. The 17-year-old was arrested about an hour after the incident. The gun was apparently in the boy’s backpack and was inadvertently discharged when he slammed his backpack down on his desk. The two wounded students, both 15, were taken to Harbor-UCLA Medical Center, where a girl who had been shot in the head underwent lengthy surgery. She was in critical condition with a skull fracture and brain trauma. A boy who had been shot in the neck was listed as stable; his wound was not life-threatening.</p>
<p>Assault with a deadly weapon is a serious crime in California and carries a maximum sentence of 3 years in state prison. It is also a &#8220;strike&#8221; offense which means that if convicted and sent to prison on this charge a defendant will serve 85% of their sentence as opposed to those who serve 50% of their sentences for &#8220;non-strike&#8221; felonies. In addition, if one is convicted of a &#8220;strike&#8221; offense and they pick up a new felony, the sentence will be doubled if they are sent to prison on the new charge. Here, the student charged in this case is facing two potential strike charges. If convicted of two prior strikes, a third strike carries a sentence of 25 years to life.</p>

(Penal Code § 484.) In other words, when one person attempts to cause a violent injury; such as, a person picking up a baseball bat and swinging the bat at a person’s face, it is assault.  Now, unlike battery, to be convicted of <a href="http://www.wklaw.com/assault-overview.html">assault in Los Angeles County</a> one does not have to make contact or actually commit a violent injury.  So long as the person attempted to cause the injury, then a person could be charged with assault in Los Angeles County.  </p>
<p>In order to prove assault, the district attorney must prove the following beyond a reasonable doubt:</p>
<p>•	The defendant committed an act that by its nature would directly and probably result in the application of force to a person<br />
•	The defendant did that act willfully<br />
•	When the defendant acted, he was aware of facts that would lead a reasonable person to realize that his act by its nature would directly and probably result in the application of force to someone<br />
•	When the defendant acted, he had the present ability to apply force to a person.</p>
<p>If the prosecution is successful in proving all the above elements then the person will be guilty of a misdemeanor, which is punishable by a fine not exceeding one thousand dollars, or by imprisonment in the county jail not exceeding six months, or by both fine and imprisonment.  Also, if the assault was committed on law enforcement, emergency medical personnel or a firefighter, then the punishment will be increased to a fine not exceeding two thousand dollars, or by imprisonment in the county jail not exceeding one year, or by both the fine and imprisonment.</p>

The man’s family filed a suit against the city alleging that the man was killed as a result of a severe beating at the hands of several Fullerton police officers.  On Friday, another person came forward claiming he was also a victim of police brutality at the hands of the same officer alleged to have killed the homeless man.   </p>

<p>In California, rape is codified under Penal Code Section 261.  It states in pertinent part that rape occurs when there is sexual intercourse “Where it is accomplished against a person&#8217;s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another”.</p>
<p>If convicted of rape, a person faces up to eight years in state prison on a 1st offense.</p>

<p>Sources indicate that Strauss-Kahn forcibly touched her breasts, forced her to perform oral sex on him, attempted to force her to submit to anal sex, and tried to remove her panty hose. The alleged victim escaped and called police, but when they arrived at the hotel, Strauss-Kahn had already left. Police arrested him at JFK Airport after he had already boarded his flight and was awaiting takeoff.</p>
<p>Jail officials placed him on suicide watch based on something he said or did during a jailhouse psychiatric evaluation.</p>
<p>He is being held without bail. Prior to these allegations, he was considered a frontrunner to become the next President of France.</p>

			<content:encoded><![CDATA[<p>On May 6, 2011, at around 1:40 AM, Fullerton police were called after a fight outside of CSU Fullerton frat party ended in two people sustaining stab wounds and police searching for the suspects.</p>
<p>Witnesses reported to police that several party-goers were standing outside of a Phi Sigma Kappa house when a group of six or eight males accosted two men, ages 21 and 22 years old. A fight ensued, and one of the suspects brandished a knife and stabbed the two men. The two men were transported to a local hospital for treatment and are listed in stable condition.</p>
<p>Under Penal Code section 245(a)(1), <a href="http://www.wklaw.com/areas-assault.html">assault with a deadly weapon</a> (also known as aggravated assault) is an unlawful attempt to injure someone using an object likely to cause significant injury. Though people most commonly think of deadly weapons as knifes or firearms, many common objects can be considered deadly weapons: car keys, a tree branch, a glass bottle, etc. Depending on the circumstances, assault with a deadly weapon may be charged as a misdemeanor or a felony, so punishment may range from probation and fines to up to four years in prison (if the deadly weapon is a non-firearm).</p>

			<content:encoded><![CDATA[<p>Tampa Bay Buccaneers Aqib Talib surrendered to police on Wednesday morning on a warrant for <a href="http://www.wklaw.com/Assault-With-Deadly-Weapon-Prosecution/">aggravated assault with a deadly weapon</a>, the St. Petersburg Times reported.  His mother, Okolo Talib, reportedly turned herself in Tuesday afternoon which was reported by FOXSports.com&#8217;s Adam Caplan and NewsCore.<br />
According to police, Talib was involved in a fight on March 21 with his sister&#8217;s boyfriend, Shannon Billings, the Dallas Observer reported Monday.  The incident, according to police, stemmed from an argument at Talib&#8217;s sister Saran&#8217;s house between her and Billings. Saran Talib reportedly called her brother and mother for help during the alleged altercation.<br />
In California, any person who commits an assault upon the person of<br />
another with a deadly weapon or instrument other than a firearm or by<br />
any means of force likely to produce great bodily injury shall be<br />
punished by imprisonment in the state prison for two, three, or four<br />
years, or in a county jail for not exceeding one year, or by a fine<br />
not exceeding ten thousand dollars ($10,000), or by both the fine and<br />
imprisonment.</p>
