Gang Violence And Crime in Orange County

In Costa Mesa, several juveniles and one young adult were arrested and have been charged with several felonies. The individuals are charged with felonies ranging from attempted carjacking, robbery, brandishing a firearm, conspiracy and criminal threats, as well as gang enhancement. The police have not released the identifications for the juveniles, but their ages range from 14 to 17 years old.

Apparently the group confronted a man as he ate at a Mexican restaurant on August 2. After threatening to kill him and flashing gang signs the man left and the group followed him and pulled him out of his vehicle and assaulted him until he was unconscious.

All of these charges are very serious and would be considered a “strike” offense if anyone is convicted of any of these charges. The prosecution must be able to prove several elements before a person could be convicted of these or any other crimes.

For instance, to be convicted of robbery, the prosecutor would have to be able to prove that you:
1. Took property that was not your own;
2. The property was taken from another person’s possession and immediate presence;
3. The property was taken against that person’s will;
4. Used force or fear to take the property or to prevent the person from resisting; and
5. When you used force or fear to take the property, you intended to deprive the owner of it permanently.
