On December 31, 2010, Amy Ennis, pregnant with her second child, was rearrested and sent back to prison after being mistakenly released from custody more than two years too early. During the 27 months between her release and re-arrest, she was employed, led a productive life as a mother to her first child, and did not get into any trouble.
Ennis was convicted in August 2006 and sentenced to six years in prison for child endangerment with a great bodily injury enhancement. (PC 273a(a); PC 12022(d).) She was originally scheduled to be released in May 2011, but a subsequent sentencing miscalculation changed her release date to September 2008. She was commended as model inmate and parolee.
On December 31, 2010, her parole officer contacted her, stating that it was urgent that she come to the parole office right away. When she arrived, she was arrested as a fugitive prisoner and transferred back to custody.
Upon her recommitment to custody, prison officials assured Ennis that she would be released in early May 2011. Her doctor has determined that Ennis’ second child is a high-risk pregnancy and is due on May 15.
In an interview with a Los Angeles Times reporter, Paul J. Wallin, partner at Wallin & Klarich and Ennis’ attorney, called Ennis’ re-arrest “legally questionable and morally outrageous.” Furthermore, he commented that the CDCR’s treatment of her is “an inhuman response to a woman with a high-risk pregnancy.”
