It was recently reported in the Los Angeles Times that a South Bay teen who had a long history of traffic offenses has been arrested on suspicion of DUI. The police alleged that Jaclyn Andrea Garcia plowed through a group of Torrance bicyclists critically injuring one. A search of Garcia’s driving record showed that she had been convicted of four previous driving offenses since 2009. Two bikers were injured, one of them critically. The injured biker, South Bay resident Adam Rybicki, 49, was taken to County Harbor-UCLA Medical Center. He’s listead as suffering from several broken bones and in a coma.
Under California Vehicle Code section 23152(a) it is against the law for any person who is under the influence of any alcoholic beverage or drug to drive a vehicle. Furthermore, California Vehicle Code section 23152(b) makes it unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle. Ashburn will likely be charged with a violation of both Vehicle Code sections 23152(a) and 23152(b).
