To prove that the defendant is guilty of resisting arrest, the People must prove that:

1. Person was a peace officer lawfully performing or attempting to perform his duties as a peace officer;2. The defendant willfully resisted, obstructed, or delayed that officer in the performance or attempted performance of those duties;AND3. When the defendant acted, he knew, or reasonably should have known, that the person was a peace officer. Under penal code section 148(a)(1), a misdemeanor, a person who is convicted of this crime can be punished up to one (1) year in the county jail and pay a fine of up to one thousand (1,000.00) dollars and be placed on probation for up to three years. A person might be ordered to pay restitution, if in the event there was any loss of value by the officer.
