CVC 23152(A), (B) – ACTRESS JAIME PRESSLY ARRESTED ON SUSPICION OF DUI

On the night of January 5, 2011, actress Jaime Pressly was arrested in Santa Monica for driving under the influence.

Pressly has starred in a variety of acting roles, including the hit movie I Love You, Man and the television series My Name Is Earl.

Other news sources indicate that Pressly was not involved in a traffic accident, but no further details regarding her arrest have been released.   She spent the night in jail and was released after posting bail $15,000 bail.

Under the 2010 Los Angeles County bail schedule, which sets the suggested bail for every crime a person has been charged with in Los Angeles County, the normal bail set for suspicion of DUI is $5,000.  Because her bail was set at $15,000, other aggravating circumstances may have been alleged against her, such as a blood alcohol content over .15 percent or a refusal to submit to a chemical test.

If a law enforcement officer initiates a vehicle stop on suspicion of DUI, know your rights.  Besides providing identifying information, vehicle registration, and proof of insurance, you have a right to refuse to answer any of the officer’s questions.  Commonly, officers will ask you if you’ve been drinking.  You have a right not to answer that question.  Also, officers frequently ask that you submit to field sobriety tests, such as asking you to look at a moving penlight, recite the alphabet backwards, or asking that you step outside the vehicle and perform physical tasks.  These tests are designed to reveal indications of intoxication.  You may legally refuse to perform these tests.  However, you have no legal right to refuse if an officer orders you to submit to a chemical test, such as a breathalyzer or a blood test.  Contact a Los Angeles County DUI lawyer if you have further questions.
