WHO OWNS THE LOS ANGELES DODGERS BASEBALL CLUB?

The Associated Press reported on September 27, 2010,  that Testimony in the divorce case of Frank and Jamie McCourt will resume Monday in a Los Angeles courtroom, where a judge could decide who owns the Dodgers.
Negotiations held Friday failed to resolve differences between the McCourts.
At issue are two versions of a postnuptial marital agreement the couple signed in 2004. One version gives both McCourts ownership of the baseball team, Dodger stadium and surrounding land. Another makes them the sole property of Frank McCourt. Jamie McCourt is challenging that version and seeking a slice of the Dodgers under California’s community property law.

Absent these agreements in dispute, The ball club would presumably be community property assuming that the ball club was purchased/acquired during the McCourt’s marriage. The interesting thing about this high profile divorce is the two competing versions of a postnuptial agreement signed in 2004. It will ultimately come down to testiomonial evidence and perhaps even expert testimony as to the validity of each of the documents.
