Recently, the OC register reported that Neftali Procopio, from Santa Ana, was charged with having sex and furnishing marijuana to a 12 year old female victim. He was scheduled to be arraigned on the two felonies however that was reset for September 3, 2010 and bail was set at 100,000.00 dollars.
The accused apparently met the victim earlier that day at a local high school, and then arranged for her to sneak out of her home to meet him. Prosecutors then claim that he gave her marijuana and then proceeded to have unlawful sex with the victim.
Under PC 288 (a); any person who willfully and lewdly commits any lewd or lascivious act, upon or with the body, or any part or member thereof, of a child who is under the age of 14 years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of that person or the child, is guilty of a felony and shall be punished by imprisonment in the state prison for three, six, or eight years.
