Braylon Edwards, the wide receiver for the New York Jets was arrested in Manhattan on West Street near 34th Street on charges of drunk driving.
According to police reports, Edwards was pulled over at approximately 5:15 a.m. on Tuesday morning by a marked police cruiser. The officers had stopped Edwards because they suspected that the tints on the windows of his 2007 Land Rover were too dark.
When the officers approached the vehicle, they reportedly smelled alcohol on Edwards’ breath. They then submitted Edwards to a breathalyzer test, which he failed by blowing a 0.16%, twice the legal limit. A woman and two men, one of which was a Jets teammate, were also present in the vehicle at the time of the stop. Edwards is expected to be arraigned in court next week in Manhattan Criminal court.
Drunk driving is a serious criminal offense in California under Vehicle Code Section 23152. A violation of this section can occur when a person drives a motor vehicle while under the influence of drugs or alcohol, or when a person drives with a blood alcohol concentration (BAC) of 0.08% or more.
A first-time conviction for driving under the influence (DUI) may result in imprisonment in county jail for a period of up to six months and probation for up to five years. A DUI conviction may also result in the DMV suspending your driving privileges for a six-month period. See California Penal Code Section 13352. The penalties increase in severity for every subsequent DUI conviction.
If you are facing DUI charges, an experienced Orange County DUI defense attorney can help you present any viable defense in your case. Depending on the circumstances of your arrest, your attorney may be able to factually show that you were not under the influence or that you were not driving. Your attorney may also expose any defect in police procedures (i.e., Miranda, field sobriety tests, blood tests, etc.) that may allow you to eliminate the evidence against you.
