Couple Steals 16 Rolex Watches from Irvine Jewelry Story – California Penal Code Section 459

It was recently reported in the OC Register that an Irvine jewelry store was burglarized on August 17, 2010.  David Lee Jewelers in Irvine reported a man and a woman stole 16 Rolex watches from a display case.  The two people came into the store as a couple and are believed to have stolen the Rolex watches when the store clerk was busy helping other customers.  The watches were worth an estimated total of $376,000.  The couple has not been arrested.

This crime is considered a second degree burglary under California Penal Code Section 459.  Burglary is committed when a person enters a building, vehicle, vessel, or cargo container with the intention of either stealing something or committing a felony.  A second degree burglary occurs when the theft crime is committed in a business.  This is also known as “commercial burglary.”  Burglary in the second degree is considered to be a “wobbler.”  This means that the prosecution has the discretion to charge the crime as either a felony or a misdemeanor.  A felony conviction is punishable by imprisonment in state prison for up to three years.  A misdemeanor conviction is punishable by imprisonment in county jail for up to one year.
