The California Supreme Court held oral arguments in November in People v. Robinson. The case involves a man who was convicted after his blood was illegally drawn and his DNA submitted to the state database.
The DNA happened to match some DNA that was taken at the scene of a rape. Four days before the statute of limitations was set to expire, the District Attorney filed charges against the then unknown male. Later, the match was linked to the defendant and he was eventually convicted and sentenced to 65 years in prison.
In oral argument, some members of the high court indicated that despite the illegal drawing of blood, the conviction may be upheld because DNA evidence has a proven reliability. California does not have a law that allows someone to be indicted based only on their DNA profile which makes a decision in the defendant’s favor (a reversal of the conviction) more likely.
