Child Abuse Central Index – Notice of Your Name Being Put on CACI
In order to list anyone on the CACI, the county is required to notify the individual within five (5) business days of submitting the information to the Department of Justice. It is very important that the person to be listed on the CACI hire a knowledgeable attorney because of the strict time requirements and the consequences of being listed on the CACI. If the allegation placing you on the list was substantiated, you will remain on CACI permanently, but if the allegations are inconclusive, you will be removed from the list after 10 years as long as no new allegation of child abuse or neglect arise against you.

The notice the county is required to give must contain all of the following:
1. Whether the results of the investigation of the alleged child abuse or neglect are inconclusive or substantiated, and whether the county has referred the individual to the DOJ for listing on the CACI index ;
2. The victim’s name, a brief description of the alleged abuse or neglect, and the date and location where it occurred ;
3. Notice that the individual has a right to a grievance hearing;
4. A person they can contact with the county
5. A form to request a grievance hearing; AND
6. A copy of the grievance procedures
Making an Inquiry to the Department of Justice
If an individual wishes to find out whether their name appears on the CACI database, the individual must submit a notarized Child Abuse Central Index Self Inquiry Request form pursuant to Penal Code Section 11170(f)(1). This form is available at the Department of Justice (DOJ) website.

If the individual’s name does appear on the CACI database, the DOJ will notify that person in writing that they are listed as a suspect or victim. The writing will include:
1. The name of the reporting agency,
2. The number for the reporting agency’s investigative file,
3. The date of the report,
4. The date of any disclosures,
5. The name of the agency to which the individual’s record was disclosed,
6. The purpose of the disclosure, AND
7. A copy of the individual’s personal information.
